Land Grant to Peter Hollow (October 8, 1766)

CONTEXT

In this October 8, 1766, land grant to Peter Haller (misspelled as “Hollow”), Thomas Fairfax, 6th Lord Fairfax gives him ownership of 372 acres of the Northern Neck Proprietary, which consisted of over 5.2 million acres, located between the Rappahannock and Potomac rivers, and stretching into what is now West Virginia. In a proprietary colony of the British Empire, all the land belonged to the monarch, who distributed it via commercial charters to individuals and companies. Known as proprietors, they acted on behalf of the monarch, dividing up the proprietary land to willing buyers, among them Peter Haller. Haller’s land became the site for the community of Lantz Mill. This propriety system did not recognize the sovereign rights of Virginia Indians and their ancestral lands.

The Right Honourable Thomas Lord Fairfax— 

Baron of Cameron in that Part of Great Britain called Scotland Proprietor of The Northern Neck of Virginia To all To whom this present Writing shall come sends Greeting. Know ye, That for good Causes for and in Consideration of the Composition to me paid and for the annual Rent herein after reserved I have given granted and confirmed and by these Presents for me my Heirs and Assigns do give grant and confirm unto Peter Hollow of Frederick County A Certain Tract of Waste and ungranted Land on both Sides of Stony Creek in The said County And bounded as by a Survey thereof made by Robert Rutherford— Beginning On the South Side of the Creek at a Black Oak and Hickory Corner to the said Hollow’s other Survey and standing in the Line of Christian Coffield on a Hill— There extending with Coffield’s Lines So. 40 E[as]t Fifty four Poles crossing a Branch to the Bank of Stony Creek near two White Oaks— Thence up the Creek and binding on the same No. 50 W[es]t Forty Poles. No[rth] 70 Wt Thirty two Poles— No. 80 Wt Thirty nine Poles— No. 10 W[t] Twenty Poles— No. 25 Wt Forty Poles—No. 16 Et. Twenty Poles crossing the Creek to a double bodied Sycamore Corner to William McKenny— Therewith Mr Kenny’s Line N. 46 Et. Two hundred and sixteen Poles to his Corner three Pines by a Drain— Then So[uth] 44 Et. One hundred and seventy six Poles to Isaac Ruddles’s Line by three Pines in a Valley—Then with Ruddle’s Lines So. 20 Wt Three hundred Poles to two Pines—Then No. 70 Wt Fifty five Poles crossing the Creek to a Black Oak on the Bank in the said Ruddle’s Line and a Corner to the said Hollow’s other Survey—Thence up the Creek and binding on the same with the Lines of his other Survey Sixty two Poles to a double bodied Black oak on the Bank of the Creek and a Corner to his other Survey and exthence with a Line of the same West Ninety six Poles to the Beginning Containing Three Hundred and seventy two Acres— Together with all Rights Members and Appertenances thereunto belonging Royal Mines excepted And a full Third Part of all Lead Copper Tin Coals Iron Mine and Iron Ore that shall be found thereon—To have & to hold The said Three hundred and seventy two Acres of Land together with all Rights Profits and Benefits to the same belonging or in anywise appertaining Except before excepted— To him The said Peter Hollow his Heirs and Assigns Forever— He The said Peter Hollow his Heirs and Assigns therefore Yielding & Paying to me my Heirs or Assigns or to my Certain Attorney or Attornies Agent or Agents or to the Certain Attorney or Attornies of my Heirs or Assigns Proprietors of the said Northern Neck Yearly and every Year on The Feast Day of St. Michael the Archangel. The Fee Rent of One Shilling Sterling Money for every Fifty Acres of Land hereby granted and so proportionably for a greater or lesser Quantity— Provided That if the said Peter Hollow his Heirs and Assigns shall not pay the said reserved annual Rent as aforesaid so that the same or any Part thereof shall be behind and unpaid by the Space of Two whole Years after the same shall become due If legally demanded That then it shall and may be lawful for me my Heirs or Assigns Proprietors as aforesaid my or their Certain Attorney or Attornies Agent or Agents into the above granted Premises to reenter and hold the same so as if this Grant had never passed Given At my Office in the County of Frederick under my Hand and Seal— Dated the 8th Day of October AD 1766— — —
